Dam Safety Registration Recently (late 2005/early 2006) the Massachusetts of Dam Safety has sent out a Dam Registration Form to cranberry growers under the Dam Safety Regulations – 302 CMR 10.00. Not all growers have received this registration form but if you did, there are some items to be aware of. First, for an overall understanding of the Dam Safety Regulations, please refer to the July 2005 Grower Advisory titled “Dam Maintenance, Safety and Liability” (PDF:59 KB)
However, in order to comply with the process, you must respond to the Office of Dam Safety within 30 days of receipt of their letter, even if your structure is exempt. To do this, you need to send a letter to the Commissioner of Dams, stating that you are exempt. The department will then review your letter and make a determination. As always, certified mail is your best choice. If you would like help crafting a response letter, a response template has been created below. Be sure to revise the letter to insert your particular farm name, whether you are referring to one dam or several, the National Dam ID number, the location of the dam (include latitude/longitude if possible otherwise a physical description to the best of your ability, describing local landmarks, roads, etc.) and which section(s) of the regulations you have selected as part of determining your exempt status. The sections of the letter to be edited are denoted with italics. Please contact the CCCGA office with any questions or if you need assistance identifying or locating (lat/long) your dams. Response letter to be edited as you wish:
